Terms of Service

Effective 2026-09-21. This is version 2026-09-21 of the Terms.

1. Agreement

These Terms of Service (the “Terms”) are an agreement between you and WhereWolf (“WhereWolf”, “we”, “us”). They govern your use of the WhereWolf website, the WhereWolf client software, and everything provided through them (together, the “Service”).

By creating an account, subscribing, downloading, installing or running the software, you agree to these Terms. If you do not agree, do not use the Service.

2. What WhereWolf is, and is not

WhereWolf is independent third-party software. It is not made, endorsed, sponsored or supported by the developer or publisher of any game you use it with, and it is not affiliated with them in any way. The games it works with, and all names and marks associated with them, belong to their respective owners.

The software runs on your computer alongside the game. It reads information from the running game process on your PC and draws a separate overlay window on top of it. It does not modify game files, does not write to the game process, does not inject code into it, does not send input on your behalf, does not intercept the game’s network traffic, does not install a driver or change your registry, and does not connect to the game’s servers.

The Service is provided for research, educational and informational purposes only. You decide whether, when and how to use it, and you are solely responsible for that decision.

3. Your game account is your responsibility

Read this section carefully. The Service is designed for use with Monsters & Memories. Using third-party software with an online game may violate that game’s terms of service, rules of conduct, or end-user license agreement (EULA). The operator of Monsters & Memories, and the developer, publisher or operator of any other game you use the Service with, may treat use of the Service as a violation of that game’s terms of service, rules of conduct or EULA, whether or not we believe it is one.

The consequences of such a determination may include, without limitation, warnings, temporary suspension, permanent closure of your game account, loss of characters, items, currency, progress, purchases and subscriptions associated with that account, and exclusion from the game and related services. These outcomes are entirely within the control of the game’s operator, not ours.

You accept the entire risk of every such consequence. WhereWolf is not responsible or liable for any action taken against your game account or against you by the game’s developer, publisher or operator, or by any other third party, arising from or relating to your use of the Service. We will not compensate you for any such action, we cannot reverse it, and we cannot assist with appeals.

WHEREWOLF MAKES NO REPRESENTATION, WARRANTY, PROMISE OR GUARANTEE OF ANY KIND ABOUT YOUR STANDING, ACCOUNT STATUS, ELIGIBILITY OR GOOD STANDING WITH MONSTERS & MEMORIES OR ANY OTHER GAME. WHEREWOLF HAS NO CONTROL OVER AND NO RELATIONSHIP WITH THE OPERATOR OF ANY SUCH GAME AND CANNOT PREDICT DETECTION, INVESTIGATION, SUSPENSION, BANNING OR OTHER ENFORCEMENT. NO STATEMENT BY WHEREWOLF OR ITS STAFF, WEBSITE, FORUMS, DISCORD OR SUPPORT CHANNELS MAY BE RELIED ON AS ANY ASSURANCE THAT USE OF THE SERVICE IS PERMITTED OR UNDETECTABLE, OR THAT NO WARNING, SUSPENSION, BAN OR OTHER ENFORCEMENT WILL FOLLOW.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (a) YOU HAVE READ THIS SECTION 3; (b) USE OF THE SERVICE MAY VIOLATE THE TERMS OF SERVICE, RULES OF CONDUCT OR EULA OF MONSTERS & MEMORIES OR ANY OTHER GAME; (c) YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND COMPLYING WITH THOSE DOCUMENTS; (d) YOU MAY BE WARNED, SUSPENDED, PERMANENTLY BANNED, OR LOSE YOUR ACCOUNTS, CHARACTERS, ITEMS, CURRENCY, PROGRESS AND PURCHASES; (e) YOU KNOWINGLY, VOLUNTARILY AND EXPRESSLY ASSUME ALL OF THAT RISK; (f) YOU WAIVE AND RELEASE WHEREWOLF FROM ALL CLAIMS RELATING TO ANY SUCH ENFORCEMENT ACTION, INCLUDING CLAIMS FOR REFUNDS OR FOR THE VALUE OF LOST ACCOUNTS OR VIRTUAL PROPERTY; AND (g) YOUR DECISION TO USE THE SERVICE IS INDEPENDENT AND WAS NOT INDUCED BY ANY STATEMENT BY WHEREWOLF.

You represent that you are not subject to any contractual, court-ordered or other restriction that prohibits your use of the Service. If you are bound by an agreement with the operator of Monsters & Memories or any other game that prohibits third-party software, your use of the Service is at your sole risk and constitutes your own act, not WhereWolf’s.

If you are not willing to accept this risk, do not use the Service.

4. Eligibility and your account

You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or subscribe.

You are responsible for keeping your login credentials confidential and for everything that happens under your account. Tell us at once at info@wherewolf.club if you believe your account has been accessed without your permission.

One person, one account. You may not create accounts for others, share an account, or transfer one.

5. Your license to use the software

While your subscription is active and you comply with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and run the software on the number of computers your plan allows, for your own use.

You may not: share, sell, rent, lend or sublicense the software, your account, or any activation key; copy, modify, translate, decompile, disassemble, reverse engineer or create derivative works from the software, except where the law expressly permits it despite this restriction; remove or alter any notice or identification in the software; interfere with, probe, bypass or circumvent any licensing, activation, seat limit, update or security mechanism of the Service; use the Service to attack, overload or disrupt our systems or anyone else’s; or use the Service in any way that is unlawful.

The software and the Service, including all code, designs, data and content, are owned by WhereWolf or its licensors and are protected by intellectual property law. Nothing in these Terms transfers any ownership to you.

6. Subscriptions, payment and cancellation

Access to the software requires a paid subscription. Prices are shown before you subscribe and are charged in advance for each billing period. Payments are processed by Stripe; we do not store your card number.

Your subscription renews automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from the Billing page of your account. Cancelling stops future renewals; your access continues until the end of the period you have already paid for.

Except where the law requires otherwise, payments are non-refundable and there are no refunds or credits for partial periods, unused time, or periods during which the software did not work with the game (see section 7).

If we change the price of your plan, we will tell you before the change takes effect at your next renewal. If you do not agree, cancel before that renewal.

If a payment fails, or a charge is disputed or reversed, we may suspend or end your access until it is resolved.

7. Availability, game updates and changes

The software depends on the internal structure of a game we do not control. Any update to the game may stop the software working, in whole or in part, without notice. We work to restore function after game updates, but we do not promise that we will, how quickly, or that any particular feature will return.

We may add, change, limit or remove features of the Service at any time. We may suspend the Service for maintenance or for reasons outside our control.

We may discontinue the Service altogether. If we do, we will give notice by email or on the website, and we will refund the unused portion of any period you have prepaid. That refund is the only remedy for discontinuation.

WHEREWOLF MAY, IMMEDIATELY AND WITHOUT NOTICE OR LIABILITY, SUSPEND, RESTRICT, DISABLE, DEGRADE OR PERMANENTLY DISCONTINUE THE SERVICE, IN WHOLE OR AS TO ANY GAME, FEATURE OR USER, IF IT RECEIVES A CEASE-AND-DESIST DEMAND, DMCA NOTICE, TAKEDOWN REQUEST, SUBPOENA, OR THREATENED OR ACTUAL CLAIM OR PROCEEDING FROM A GAME DEVELOPER, PUBLISHER OR OPERATOR OR ANY OTHER THIRD PARTY, OR IF IT DETERMINES IN ITS SOLE DISCRETION THAT CONTINUED OPERATION CREATES LEGAL, REGULATORY, PLATFORM OR REPUTATIONAL RISK. ANY SUCH ACTION IS NOT A BREACH OF THESE TERMS AND GIVES RISE TO NO LIABILITY, DAMAGES, SPECIFIC PERFORMANCE OR CLAIM OF ANY KIND. THE USER’S SOLE REMEDY IS, AT WHEREWOLF’S OPTION, A PRO RATA REFUND OF THE UNUSED PREPAID PORTION OF THE THEN-CURRENT BILLING PERIOD.

WHEREWOLF MAY COMPLY WITH ANY SUCH DEMAND OR PROCESS, REMOVE FEATURES, CEASE SUPPORT FOR A GAME, OR OTHERWISE CHANGE OR STOP THE SERVICE, AND MAY DO SO WITHOUT ADVANCE NOTICE. WHEREWOLF HAS NO OBLIGATION TO LITIGATE, DEFEND, CONTEST OR APPEAL ANY SUCH DEMAND OR PROCESS FOR THE BENEFIT OF USERS.

8. Information we collect

This section lists everything the Service collects. If something is not listed here, the Service does not collect it.

Your account: your email address and your password, which is stored only in hashed form. Billing: your payment details are held by Stripe, which tells us the status of your subscription; we never see or store your card number.

From each computer you activate, for seat counting and to detect a license copied to other hardware: identifiers of that computer (its Windows machine identifier, firmware identifier, system volume serial and processor identifier), sent only as one-way cryptographic digests, never as the raw values; the Windows build number; the version of our software; and a fingerprint of the game’s own program file (its name, size, timestamps and a hash of its header), which tells us which release of the game is installed and nothing about you or your game account.

Also from each computer you activate: its computer name (for example “DESKTOP-7Q2”), stored as a label so that you, and our support staff, can tell your activated PCs apart on your license. It is shown back to you and used only to identify a machine; if you would rather it not leave your PC, rename the computer before you activate it.

Usage of the software, tied to your account: when it starts and stops and for how long it ran; how long it took to start; short error codes when something fails (a code, never a message or a stack trace); performance measurements such as frame timing; which overlay controls you use, how often, and what they are set to; and the name of the in-game zone you are in together with the time you spend there.

Map accuracy checks: for the zone you are in, whether the map supplied with the software still matches the game’s current layout (a yes or no), together with the zone’s name, an identifier of the game version you have installed, and an identifier of the map version. This tells us which maps need updating after a game update. No game content is sent.

What the software never collects or transmits: your game login or password (they never pass through our software); chat; your character’s name or position; other players’ names; or anything else it reads from the game’s memory, except the map accuracy check described above, the position you choose when you place a map note yourself, and, only if you turn it on, the map pins described below. Entities near you are read and drawn on your screen; unless you turn on map pins from your radar, they are not sent to us.

Map pins from your radar (off unless you turn them on). The Service includes an optional feature that records the things your radar sees as pins on your own map. It is off unless you switch it on from your account page, where this paragraph is shown to you, and we record when you switched it on and which version of this text you saw. While it is on, and only while it is on, the software sends us, tied to your account, reports of public game information it reads near you, the kind any player can see: non-player characters, resource nodes, crafting stations and similar fixed objects (such as forges, looms and game boards), and named or rare monsters, limited to names we have chosen to include. Each report contains the kind of thing, its name as the game shows it (up to 64 characters), an icon label, its position in the game world, and the time it was seen, together with the zone and an identifier of the game version. It never reports other players, pets, corpses or ordinary monsters, and never sends chat or your character’s name. What it sends becomes a pin on your own map, kept with your account and shown to you: it is not shown to other players, and there is no shared or community map it feeds. We will not show your pins to other players unless these Terms change to allow it and you switch the feature on again under that new text. Your pins are kept until you delete them or delete your account, whichever comes first. You can switch the feature off at any time; we stop accepting reports from your account immediately.

What our staff can see. Our staff can see the pins and notes on your map, next to the account they belong to: what each one says, where it is, and when it was made. We look at them to support you, to deal with misuse, and to decide how the Service should develop. This includes anything you type on a marker yourself, so treat a note on your map as something we can read, not as a private diary.

Third-party integrations you set up yourself are the exception, and go to the third party, not to us. If you connect an outside service to the Service (for example, a Discord webhook you paste in), the software sends information to that service, which you chose, at the time the relevant in-game event happens. Exactly what is sent is described where you connect it, and it never includes anything that identifies you. Remove the integration and it stops. Once information reaches that third party, their terms and privacy policy govern it, not ours.

We do not sell your information. We use it to provide, secure, support and improve the Service, to bill you, and to meet legal obligations. We may share it with service providers who process it for us under contract, or when the law requires.

You can ask us at info@wherewolf.club to see or delete the information we hold about you. Deleting your account ends your subscription and your license.

9. No warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPATIBILITY, AND UNINTERRUPTED, CONTINUED, OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL WORK WITH OR BE COMPATIBLE WITH ANY CURRENT OR FUTURE VERSION OF MONSTERS & MEMORIES OR ANY OTHER GAME, THAT ITS OUTPUT WILL BE ACCURATE, THAT IT WILL REMAIN AVAILABLE, THAT ITS USE WILL BE UNDETECTABLE, OR THAT USE OF THE SERVICE IS LAWFUL OR PERMITTED UNDER ANY GAME’S TERMS OF SERVICE, RULES OF CONDUCT OR EULA.

NO ORAL OR WRITTEN ADVICE, GUIDANCE, SUPPORT, STATEMENT OR INFORMATION PROVIDED BY WHEREWOLF OR ANY OTHER PERSON CREATES A WARRANTY OR EXPANDS ANY WARRANTY IN THESE TERMS. YOU ASSUME THE ENTIRE COST OF ALL SERVICING, REPAIR OR CORRECTION. NOTHING IN THE SERVICE DESCRIPTION CONSTITUTES LEGAL ADVICE ABOUT WHETHER USE OF THE SERVICE COMPLIES WITH ANY THIRD PARTY’S TERMS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WHEREWOLF AND ITS OWNERS, OPERATORS, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE ABOVE, WE ARE NOT LIABLE FOR ANY SUSPENSION, BAN, TERMINATION, PENALTY OR LOSS RELATING TO YOUR GAME ACCOUNT, OR FOR ANY LOSS OF CHARACTERS, ITEMS, CURRENCY, PROGRESS, PURCHASES OR SUBSCRIPTIONS IN THE GAME.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE LESSER OF (A) THE SUBSCRIPTION FEES YOU ACTUALLY PAID TO WHEREWOLF IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

TO THE FULLEST EXTENT PERMITTED BY LAW, THE EXCLUSIONS AND CAP IN THIS SECTION 10 APPLY TO ALL CLAIMS AND THEORIES, INCLUDING UNDER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, MISREPRESENTATION OR OTHERWISE, APPLY TO WHEREWOLF AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SUPPLIERS, AND SURVIVE TERMINATION OF THESE TERMS.

THE LIMITATIONS IN THIS SECTION 10 ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND WHEREWOLF AND APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

YOU HAVE NO RIGHT TO RECOVER THE VALUE OF ANY GAME ACCOUNT, CHARACTER, ITEM, VIRTUAL CURRENCY, IN-GAME PURCHASE, PROGRESS OR LOST SUBSCRIPTION PAID TO THE GAME’S OPERATOR. LOST TIME, COMPETITIVE STANDING AND REPUTATIONAL HARM ARE EXCLUDED.

TO THE EXTENT PERMITTED BY NORTH CAROLINA LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS MUST BE FILED IN A COURT OR ARBITRATION WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE, OR IT IS PERMANENTLY BARRED.

Some jurisdictions do not allow certain exclusions or limitations. In those places, these limits apply to the fullest extent the law allows.

11. Indemnity

YOU WILL DEFEND, INDEMNIFY AND HOLD HARMLESS WHEREWOLF AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SUPPLIERS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, PROCEEDINGS, INVESTIGATIONS, LOSSES, DAMAGES, LIABILITIES, JUDGMENTS, SETTLEMENTS, FINES, PENALTIES, COSTS AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES AND COSTS OF INVESTIGATION AND DEFENSE, ARISING OUT OF OR RELATING TO: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) YOUR BREACH OF THESE TERMS; (C) YOUR VIOLATION OF ANY LAW OR ANY THIRD PARTY’S RIGHTS; (D) YOUR BREACH OR ALLEGED BREACH OF THE TERMS OF SERVICE, RULES OF CONDUCT OR EULA OF MONSTERS & MEMORIES OR ANY OTHER GAME; (E) ANY CLAIM BROUGHT BY YOU OR ON YOUR BEHALF RELATING TO ENFORCEMENT ACTION AGAINST A GAME ACCOUNT, INCLUDING BANS, SUSPENSIONS AND LOST VIRTUAL PROPERTY; (F) ANY CLAIM BY A GAME DEVELOPER, PUBLISHER OR OPERATOR ARISING FROM YOUR USE OF THE SERVICE; OR (G) ANY THIRD-PARTY INTEGRATION YOU CONFIGURE.

WHEREWOLF WILL HAVE SOLE CONTROL OF THE DEFENSE AND SETTLEMENT OF ANY MATTER SUBJECT TO INDEMNIFICATION, AT YOUR EXPENSE, AND YOU WILL PROVIDE FULL COOPERATION. YOU MAY NOT SETTLE ANY SUCH MATTER IN A WAY THAT IMPOSES AN OBLIGATION ON, OR CONTAINS AN ADMISSION BY, WHEREWOLF WITHOUT WHEREWOLF’S PRIOR WRITTEN CONSENT. THIS INDEMNITY IS IN ADDITION TO, AND NOT IN LIMITATION OF, THE OTHER PROTECTIONS IN THESE TERMS AND SURVIVES TERMINATION.

12. Termination

You may end this agreement at any time by cancelling your subscription and stopping use of the software.

We may suspend or end your access, with or without notice, if we reasonably believe you have broken these Terms, if required by law, or if continuing to provide the Service to you would expose us to legal risk. Fees already paid are not refunded in that case.

TERMINATION OR SUSPENSION FOR LEGAL-RISK REASONS IS WITHOUT LIABILITY TO WHEREWOLF. ON TERMINATION, YOUR LICENSE ENDS IMMEDIATELY, AND YOU MUST UNINSTALL THE SOFTWARE AND CEASE ALL USE OF THE SERVICE.

Sections 2, 3, 5 (restrictions), 9, 10, 11, 12, 14, 15, 16 and 17 survive termination.

13. Changes to these Terms

We may revise these Terms. Each version carries the date it took effect, shown at the top of this page. For material changes we will give notice by email or on the website before they take effect. Continuing to use the Service after a change takes effect means you accept the revised Terms; if you do not, cancel and stop using the Service.

14. General

These Terms are the entire agreement between you and WhereWolf about the Service and replace any earlier agreement. If any part is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of the Service. Nothing in these Terms limits any right you have under law that cannot be limited by contract. Section 17 provides additional terms on these subjects and controls where it is more specific.

15. Governing law

These Terms are governed by the laws of the State of North Carolina, United States, excluding its conflict-of-laws rules and excluding the U.N. Convention on Contracts for the International Sale of Goods. Subject to Section 16 (Dispute resolution; arbitration; class action waiver), exclusive venue and jurisdiction for any court proceeding will be in the state and federal courts located in Wake County, North Carolina, and each party consents to personal jurisdiction there and waives any objection to venue or inconvenient forum.

16. Dispute resolution; arbitration; class action waiver

IMPORTANT: THIS SECTION REQUIRES INDIVIDUAL ARBITRATION OF DISPUTES, WAIVES A JURY TRIAL, AND WAIVES CLASS, COLLECTIVE, CONSOLIDATED AND REPRESENTATIVE ACTIONS. PLEASE READ IT CAREFULLY.

Before starting arbitration or bringing a court claim, other than a small-claims action or a request for injunctive or equitable relief permitted below, the party seeking relief must send a written notice of dispute to the notice address at info@wherewolf.club. The notice must identify the sender, describe the dispute and state the relief requested. The parties must try in good faith to resolve the dispute for 30 days after the notice is received. If they do not resolve it during that period, either party may proceed under this section.

Except for the matters carved out below, all disputes, claims and controversies arising out of or relating to these Terms, the Service or the relationship between you and WhereWolf will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be seated in Charlotte, North Carolina. For consumer convenience, the parties may participate by telephone or video, proceed on documents only, or otherwise participate remotely. The Federal Arbitration Act governs this agreement to arbitrate.

Except for the class action waiver’s enforceability, which will be decided by a court, the arbitrator will have exclusive authority to decide questions about the arbitrability, formation, validity, scope and enforceability of this arbitration agreement and these Terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WHEREWOLF EACH WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING.

IF THE CLASS ACTION WAIVER IS HELD UNENFORCEABLE AS TO A CLAIM, THAT CLAIM WILL PROCEED IN COURT IN WAKE COUNTY, NORTH CAROLINA, AND THE REMAINDER OF THE DISPUTE WILL REMAIN IN INDIVIDUAL ARBITRATION. THE COURT AND ARBITRATOR SHALL ENFORCE THE REMAINDER OF THIS SECTION TO THE FULLEST EXTENT PERMITTED BY LAW.

Either party may bring an individual claim in small-claims court if the claim qualifies and remains in that court. Either party may also seek injunctive or other equitable relief in court for intellectual-property infringement, misappropriation or other misuse of intellectual property or the Service, including unauthorized access to or interference with the Service.

You may opt out of the arbitration agreement, but not the other provisions of these Terms, by sending written notice to info@wherewolf.club within 30 days after you first accept these Terms. The notice must state your name, the email address associated with your account and that you opt out of arbitration.

Arbitration fees will be allocated as provided by the applicable AAA Consumer Arbitration Rules.

17. Miscellaneous; severability; entire agreement

Except for the separate rule for the class action waiver in Section 16, if any provision of these Terms is held invalid or unenforceable, it will first be reformed to the minimum extent necessary to make it valid and enforceable. If it cannot be so reformed, it will be severed, and the remaining provisions will continue in full force and effect. The severance of one provision will not affect the remainder of these Terms.

These Terms are the entire agreement between you and WhereWolf concerning the Service and supersede all prior and contemporaneous agreements, understandings, representations, warranties, promises, marketing statements and communications about the Service, including statements in any forum, Discord or support channel.

You acknowledge that you have not relied on any representation, promise, statement or assurance that is not expressly set out in these Terms.

No failure or delay by either party in exercising any right or remedy is a waiver of that right or remedy. These Terms do not create any third-party beneficiary rights.

You may not assign or transfer these Terms or any rights under them without WhereWolf’s prior written consent. WhereWolf may assign or transfer these Terms freely, including to a successor or in connection with any merger, reorganization or sale of all or part of its assets.

Notices to WhereWolf must be sent to info@wherewolf.club. WhereWolf may give notices to you by email to the address associated with your account, through the Service or on the website. An email or electronic notice is effective when sent, unless the sender receives a delivery-failure notice.

WhereWolf is not responsible for delay or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, power or internet failures, cyberattacks, governmental action, or failures of third-party providers or game operators.

You and WhereWolf are independent contractors. These Terms do not create an agency, partnership, joint venture, fiduciary or employment relationship, and neither party may bind the other.

Headings are for convenience only and do not affect interpretation. The parties agree that these Terms will be construed neutrally, without any presumption against the drafter.

You must comply with all applicable export-control, economic-sanctions and trade laws and may not use or access the Service from a country, territory, person or entity subject to applicable prohibitions.

Nothing in these Terms limits, waives or releases any right or remedy that cannot lawfully be limited by contract under applicable consumer-protection law, including the North Carolina Unfair and Deceptive Trade Practices Act.
